STATUTE OF LIMITATIONS AFTER AN ACCIDENT

Many things can go wrong when it comes to a car accident. Being hit in the wrong place can cause an injury that can last a lifetime. Unless you receive medical care from a professional after an accident, you may not know how bad your injuries were or what the expected timeframe for healing may be. Most of the time people will walk away from an accident with none or minor injuries.

However, a trip to the doctor’s office comes with medical expenses and most people do not have expendable savings available to them for those bills. It is imperative that you speak with an attorney if you’ve been in an accident that was caused by negligence of another party. When you speak with an experienced attorney, they can help you understand what options you have after an accident.

No one want to be involved in a lawsuit after an injury, but there are times when you have no other option. Having medical treatments after an accident isn’t something you want to be involved in either. You need to provide for yourself and your family which can be difficult if you are left in a situation of not being able to work and the bills are piling up. If this is the case pursing a lawsuit may be your only option.

Sometimes complications from accidents don’t show up immediately. They may take some time to surface, and you cannot file a lawsuit if you don’t have an immediate medical issue. This is when “the discovery rule” comes into play. The statute of limitations for personal injury of three years doesn’t begin until the injury is noticed. What does this mean? It means if you were involved in an accident and didn’t realize you were injured until days later (this happens more often than not), your three-years begins when “bodily harm becomes apparent or ought to have become apparent”. This is one of the reasons you have time to file a claim.

Whether you or a loved one was injured in an accident, it is a good idea to speak with an experienced personal injury attorney after the accident. You may not be hurt, but that does not mean that you won’t have to be compensated for other damages. Give the attorneys at Hardee, Massey and Blodgett a call. We have over 58 years of combined legal experience with matters just like this. We will do everything we can to ensure you get the compensation you may deserve. Our attorneys will be by your side every step of the way.

  • Do you handle personal injury/accident cases?
  • How do your firm’s fees work?
  • What is the process in handling my case?

WHAT YOU SHOULD BRING TO YOU PERSONAL INJURY CONSULTATION

When you’re looking for an injury attorney, it’s important to find the right person for you and your case. Most personal injury law offices offer free consultations, so it is a perfect time to check around and find the right fit for you. Here are a few additional tips:
  • Research the attorney. Find out a little about their background via word of mouth or online searches.
  • How do the fees work? At Hardee, Massey & Blodgett we work on a contingency fee basis, which means we only collect fees if there is a successful outcome for our client. Not all firms operate the same – some may charge hourly or even charge a flat rate. Make sure you know how the fees work before signing on the dotted line.
  • What does the legal process look like? No two cases are the same. Ask questions about what your case might look like – will they want to settle? Are they willing to go to trial? Do they have trial experience? Every case is going to have a different outcome, but it doesn’t hurt to be prepared doing into the case.

5 WAYS TO PREVENT AUTO ACCIDENTS

No matter how much people try to avoid auto accidents they happen. Especially in Greenville, NC, with East Carolina University back in session, there are more students and drivers on our roadways. There are many types of collisions, from rear-end accidents to DUI accidents or simple fender bender crashes can can range in severity and intensity. Safe driving goes a long way to improving your safety.

HERE ARE SOME TIPS ON PREVENTING AUTO COLLISIONS:

Obey our traffic lights and stop signs – You should always come to a complete stop at red traffic lights and stop signs. Running a red light increases your risk of being involved in an accident and possibly causing a wrongful death due to a side-impact accident or rollover collisions. To avoid these types of accidents, always come to a complete stop and look both ways for oncoming cars before proceeding.

Keep your distance – Make sure you drive a safe distance from the car in front of you so if they suddenly stop you will not rear-end them. It is recommended to you leave one full car length per 10 miles per hour  between your car and the one in front of you.

Don’t get distracted – Distracted driving is the number one cause of auto crashes. Distracted driving is when you take your attention or eyes  off the road (texting, talking, changing the radio station, etc.).

Use your turn signals – Making unsafe lane changes can be dangerous to both you, and the drivers around you. To prevent auto collisions use your right and left turn signals and always check your blind spots before changing lanes.

Never drive drowsy – Tired driving is not discussed nearly enough. Drowsy driving can be as dangerous as driving under the influence of alcohol or drugs. When you drive tired there are similar side effects just like if you were to drive under the influence. If you find yourself behind the wheel and feel yourself wanting to fall asleep, pull over, take a nap or get a room for the evening.

It’s important while on the road to pay attention to your driving and those around you. Stay alert so you can try to prevent any possible collisions that may occur.

If you or a loved one has been injured in an auto accident, call Hardee, Massey & Blodgett, LLP after you’ve contacted authorities and received medical treatment. Call our team at 252-378-2525 for help with your next steps on moving forward.
